Receive Information on City of Fort Bragg Letter to DTSC Regarding Appropriate and Relevant Regulations for Mill Pond Remediation Alternatives in the OUE Feasibility Study

 

Summary

This is an informational item.  On August 23, 2018 the City received a letter from the Department of Toxic Substances Control (DTSC) requesting a conformance analysis of OUE Feasibility Study remediation alternatives for various ponds on the GP Mill Site with the City's Coastal General Plan and other relevant regulations.  As the project descriptions supplied by DTSC were conceptual in nature, the City's analysis of the remediation alternatives' compliance with the City's Coastal General Plan was also preliminary and conceptual.  Staff discussed the preliminary analysis with Bob Merrill of the Coastal Commission on two separate conference calls to develop general consistency between the interpretations and regulatory analyses included in the City's and the Coastal Commission’s letters to the DTSC.  Staff has attached the DTSC's letter, the City's response letter and the preliminary conceptual analysis of FS project alternative conformance with the City's Coastal General Plan policies.  The analysis is neither exhaustive nor conclusive because the project descriptions were conceptual.

A complete analysis will come forward to  the Planning Commission and the City Council, after the FS and the RAP is complete and GP submits a Coastal Development Permit application to the City.   The City will at that time also complete a CEQA review (likely an EIR) as part of any Coastal Development Permit analysis and consideration process.
