Authorize City Manager to Execute Streambed Alteration Agreement with California Department of Fish and Wildlife for Waterfall Gulch to Hare Creek, Notification No. 1600-2016-0271-R1 

Summary
The Streambed Alteration Agreement applies to the City’s gravity fed water diversion on Waterfall Gulch and is intended to protect existing fish and wildlife resources.  The diverted water is used for essential municipal purposes and is diverted to offstream storage at Summers Lane Reservoir under Water Right License No. 12171.  The Agreement provides for at least a 25% bypass of water, except when the Summers Lane Reservoir is not full and during water emergencies.  The execution of this Agreement became an after the fact requirement in order for Humboldt County to release the $700,000 Prop. 84 grant funds to the City.  California Department of Fish and Wildlife has assured the City that upon execution of this Agreement, it will initiate release of those funds in a prompt and timely manner.
