Adopt City Council Resolution Authorizing Amendment No. 4 to Caspar Transfer Station Operations Agreement and Lease between County of Mendocino and Solid Waste of Willits to Add Scrap Metal and Electronics to the Recycling Commodity Index

Summary
The City of Fort Bragg and Mendocino County jointly own the closed Caspar Landfill and the Caspar Transfer Station and the facilities are governed under a Joint Powers Agreement between the two public entities. The Caspar Transfer Station is operated by a private operator, Solid Waste of Willits (SWOW), in accordance with the Caspar Transfer Station Operations Agreement & Lease (Agreement) between SWOW and Mendocino County. Any amendments to the Agreement require the concurrence of the Fort Bragg City Council.
MSWMA General Manager Louisa Morris, administrator of the Mendocino County/SWOW contract, has recommended an amendment to the Agreement which will modify Section 14(D) of the Agreement to add scrap metal and electronics to the Recycling Commodity Index, so that fluctuations in these commodity prices will be included in the annual rate adjustment. This amendment was reviewed by the Caspar Joint Coordinating Committee on May 12, 2017 and is recommended for approval.

If approved by the Mendocino County Board of Supervisors and Solid Waste of Willits, Amendment No. 4 would modify Section 14(D) of the Agreement to add scrap metal and electronics to the Recycling Commodity Index as follows:

D. Recycling Commodity Value Adjustment
The gross market commodity value of certain Discarded Recyclable Materials collected by Grantee pursuant to this Agreement as mixed Recyclables shall be estimated from the tons collected and the average composite market value as calculated by the following weighted profile, with each category multiplied by the market price including any California Redemption Value, FOB at the Designated Recycling Processing Facility.
