Adopt City Council Resolution Approving Concessionaire Agreement between the City of Fort Bragg and North Coast Segway Tours to Operate Segway Tours in City Parks and Authorizing City Manager to Execute Same
Summary
On April 10, 2017, City Council provided direction to staff regarding use of Segways, a type of Electric Personal Assistive Mobility Device (EPAMD), on the Fort Bragg Coastal Trail and other City parks. Councilmembers agreed that a concessionaire agreement would be required for commercial use of Segways on the Coastal Trail, and that the City may recover costs for staff time for preparation of the concessionaire agreement. Council directed that the concessionaire agreement should include the following: (1) requirement for $2 million in general liability insurance, with the City of Fort Bragg as an additional insured party; (2) requirement that tours be limited to nine or fewer people; (3) required use of safety equipment, and (4) requirement that each tour has a tour leader. Hours and days of tour operation were not to be limited, and initial permit and annual renewal fees are to be discussed when the next City Fee Schedule update is prepared. In accordance with the Council's direction, Ordinance No. 929-2017 was introduced at the April 24, 2017 City Council meeting to allow Segways in City parks. On May 8, Ordinance No. 929-2017 was adopted, with a slight correction to allow “Segways and Segway-like vehicles.” Staff has drafted a Concessionaire Agreement for North Coast Segway Tours (aka North Coast Ninebot Tours) to operate commercial tours on the Fort Bragg Coastal Trail within the City’s Noyo Headlands Park. The Concessionaire Agreement contains the required elements as directed by City Council on April 10. Staff recommends that City Council adopt a Resolution approving the Concession Agreement with North Coast Segway Tours.
