Adopt Resolution Ratifying the Director of Emergency Services' Emergency Order No. 1, Reiterating the Mendocino County Health Officer's Facial Covering Order and Establishing Administrative Penalties for Violations

 

Summary

On May 11, 2020 the City Council adopted Urgency Ordinance No. 961-2020 establishing administrative penalties for violations of the Mendocino County Health Officer’s COVID-19 Pandemic Orders. The Administrative Penalties Ordinance established a penalty of $25 for first offense, $50 for second offense and $75 for each subsequent offense of the Mendocino County Health Officer’s COVID-19 Pandemic Orders for non-commercial activities.  Additionally the Ordinance established a notice of warning that individuals and businesses would receive at least twenty-four (24) hours before a citation and penalty were issued to allow the individual or business time to abate the violation. 

 

The surge in new cases in Mendocino County and the importance of wearing of facial coverings to reduce the spread of COVID-19 as reiterated and mandated by local and state health officials led the City Council to direct the City Manager, as the Director of Emergency Services, to issue an Emergency Order: 1) increasing the amount of penalties assessed  to $100 for first offense, $250 for second offense and $500 for each subsequent offense of the Mendocino County Health Officer's Facial Covering Order, 2)  providing the Enforcement Officer discretion on whether to provide for the twenty-four (24)  hour warning abatement period, and 3) expanding the definition of Enforcement Officer to included Fort Bragg Community Services Officers (CSOs) to issue administrative citations under Urgency Ordinance 961-2020 and Emergency Order No. 1. 

 

Adoption of this Resolution will ratify the Director of Emergency Services' Emergency Order No. 1.
